Information clause on the sale of goods and services by Focus Garden

Focus Garden sp. z o.o. with its registered office in Poznań, ul. Krzywoustego 3, 61-144 Poznań, entered in the Register of Entrepreneurs of the National Court Register by the District Court Poznań - Nowe Miasto i Wilda in Poznań, 9th Commercial Division of the National Court Register under KRS number: 0000928047, NIP: 7642696142, REGON 38200646900000, (hereinafter referred to as: “Focus Garden”) is the Administrator of your personal data within the meaning of the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter referred to as GDPR). Purpose and legal basis for processing – Your personal data will be processed for the purpose of:

  • concluding and performing a contract for the sale of goods and services. Orders can be placed on the website or by telephone (pursuant to Article 6(1)(b) of the GDPR);
  • fulfilling the legal obligations incumbent on the controller, including: to demonstrate that we have obtained your personal data in accordance with the law, for the purpose of issuing and storing accounting documents relating to the sale of goods and services (pursuant to Article 6(1)(c) of the GDPR);
  • for informational and marketing purposes promoting our goods and services (based on Article 6(1)(f) of the GDPR);
  • if you give us your consent, marketing information will be provided to you electronically (based on Article 6(1)(a) of the GDPR).
  • Scope of processing of your data – data identifying you, in particular: name and surname, telephone number, as well as your home or mailing address, e-mail address. If you request an invoice, your tax identification number (NIP) will also be required. Providing data is voluntary, but it is necessary for the conclusion and performance of the contract. Information about the recipients of your personal data – these will be entities supporting us in fulfilling our rights and obligations and in providing services, in particular: those providing IT services, assistance, and technical support, intermediating in the delivery of ordered products, and performing assembly services on our behalf.

Data processing period – Your data will be processed for the duration of the contract binding us. After its completion, for the period specified in the law, e.g.: for the purposes of defense against claims – no longer than 3 years; for the purposes specified in the Accounting Act of September 29, 1994 – for a period of 5 years from the end of the financial year to which the settlements relate.

Rights – Under the terms of the GDPR, you have the right to request from the controller: 

access to your personal data, restriction of processing of your personal data, transfer of your personal data, and to object to the processing of your data.

In the case of personal data processing based on consent, you have the right to withdraw your consent at any time, without giving any reason. However, the withdrawal of consent does not affect the processing of your data until the moment of withdrawal. We will not always be able to fulfill all your requests. The scope of your rights depends on the legal grounds for data processing.

Right to lodge a complaint with a supervisory authority – if you believe that the processing of your data violates the provisions of the GDPR, you have the right to lodge a complaint with the President of the Personal Data Protection Office.
